PASS Summit 2011 “Alaska Cruise” Contest Rules

Sponsors: Professional Association for SQL Server (PASS), Holland America Line, Seattle Convention and Visitors Bureau (SCVB) (all three are the “Sponsor”)
HOW TO ENTER:
To enter the Alaska Cruise Contest (“Contest”), you must have registered for a paid Full Conference registration for PASS Summit 2011 by the Contest Deadline. Any applicable discount used in conjunction with this registration cannot exceed $200 in order to be eligible for the Contest. Current registrations will be eligible for the Contest. The contest begins on January 26, 2011, and ends on March 31, 2011 (the “Contest Period”). All entries must be received by March 31, 2011, at midnight Pacific Time (“Contest Deadline”). Each new valid registration obtained with a discount code of $200 or less and each current Full Conference registration is equivalent to one entry in the Contest.
ELIGIBILITY:
Contest is open to legal residents of Canada and the U.S., except employees (and those with whom such employees are domiciled) or agents of the Sponsor. No employee, contractor, board member, or elected board member of PASS, the Professional Association for SQL Server, or its affiliated companies, his or her spouse, or immediate family members shall be eligible to win. Additionally, PASS reserves the right to disqualify any other person from participating in the Contest where such participation would, in the sole opinion of PASS, compromise or give the appearance of compromising the integrity of the Contest.
THE PRIZE AND APPROXIMATE RETAIL VALUE:
There is one (1) prize to be won, as follows:
A Cruise Certificate (the “Prize”) valid for one (1) 7-day Alaska cruise in 2011 for two (2) people, sharing one (1) oceanview stateroom. Choice of sailing dates will be accommodated on a space available basis and will be confirmed at time of request. The approximate retail value of the Cruise Certificate is $1,700 USD.
Prize must be accepted as awarded and is not convertible to cash. Prize may not be transferred. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value.
All cruise certificates are strictly for cruise only. Costs of transportation to and from the port of embarkation, hotels, taxes, fuel supplement and surcharges as applicable, transfers, shore excursions, personal expenses on board (e.g., laundry, certain beverages, phone calls, etc.) and hotel service charges are NOT included. Any taxes on the prize are the sole responsibility of the winner.
WINNER SELECTION:
A panel of judges appointed by the Sponsor consisting of members of the PASS Board of Directors and/or PASS Headquarters and/or its representatives will review all Contest entries and will participate in the draw.
The Contest drawing and review will be completed and the winners contacted by April 1, 2011. If you have not been contacted by this date, you may assume that your entry is not a winner.
Odds of winning the Prize increase with every Full Conference PASS Summit 2011 registration made and is dependent on the final number of registrants by the Contest Deadline.
If PASS discovers the ineligibility of a winner as outlined in the official rules, the winner can be disqualified from winning any prize. PASS may select the next eligible person as the winner. The Winner will have only seven (7) days to claim the Prize. After 7 days, PASS may select the next eligible person as the winner.
All winners must sign an affidavit of eligibility and release/waiver that releases PASS from any and all liability, claims, demands, or actions resulting from acceptance and use of the prizes awarded.
TERMS AND CONDITIONS:
The Cruise Certificate is valid for a Holland America Line cruise for two (2) people sharing one stateroom. Choice of sailing dates will be accommodated on a space available basis and will be confirmed at time of request. The Cruise Certificate may be used for the sailing and number of nights indicated. The certificate may not be used for Alaska CruiseTours, World Grand Voyages.
The stateroom category will be a minimum ocean view stateroom selected by Holland America Line. If space is available, stateroom upgrades are available at an additional cost. Third and fourth persons are permitted in the same stateroom and will be charged the per person tariff per applicable brochure. Guests under 21 years of age must be accompanied by a parent, guardian or chaperone who is at least 25 years old.
All cruise certificates are strictly for cruise only. Costs of transportation to and from the port of embarkation, hotels, taxes, fuel supplement and surcharges as applicable, transfers, shore excursions, personal expenses on board (e.g., laundry, certain beverages, phone calls, etc.) and hotel service charges are NOT included.
Cancellation Protection Plan, Cancellation Protection Plan Platinum, Fly Cruise Plan, overnight hotel accommodations, and Pre- and Post-cruise packages are not available for purchase by Guests holding a Cruise Certificate. Cancellation of a cruise after the cruise has been confirmed will result in the forfeiture of the Cruise Certificate.
The Cruise Certificate is non-commissionable, non-refundable, has no cash redemption value and is non-transferable. The Cruise Certificate cannot be re-sold and cannot be used as partial payment toward a longer Holland America Line cruise. Original Cruise Certificate with payment for taxes, fuel supplement and surcharges as applicable must be submitted to Holland America Line. No partial forms or photocopies will be accepted. The Expiration Date of the Cruise Certificate cannot be extended.
All Holland America Line cruises are provided subject to the terms of the Holland America Line Cruise Contract. Please also refer to the General Information section of the applicable Holland America Line brochure and the Holland America Line web site at www.hollandamerica.com for additional information that applies to Holland America Line cruises. Please review this important information carefully. A copy of the brochure and/or Contract will be provided on request. This certificate was provided through Holland America Line's SCVB Cruise Program.
No correspondence will be entered into except with the selected winner. This contest is subject to all applicable federal, provincial, and municipal laws. Void where prohibited by law. The decision of the contest judges is final and binding on all entrants without right of appeal.
The selected winner will be required to sign and return a standard Declaration, Liability and Publicity Release, releasing the Sponsor, their respective advertising and promotional agencies, and the contest judges from any and all liability arising directly or indirectly from this contest, participation in contest-related activities, the awarding of a prize, and the use or misuse of any prize.
By entering the contest, selected winners agree to comply with these official contest rules and agree to the publication, reproduction, and/or other use of their name, address, company, voice, statements about the contest, and/or personal photograph or other likeness without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast, or the Internet.
The Sponsor, its advertising and promotion agencies, and the contest judges are not responsible for late, lost, misdirected, postage-due, delayed, or illegible entries. Without limitation, the Sponsor, its advertising and promotion agencies, and the contest judges will not be liable for the failure of any entry to be received.
The Sponsor reserves the right to withdraw or amend this contest in any way, in the event of an error, technical problem, tampering, unauthorized intervention, fraud, technical failure, or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this contest as contemplated by these Rules. Any attempt to deliberately undermine the legitimate operation of this contest is a violation of criminal and civil laws, and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. The Sponsor reserves the right to cancel or suspend this contest in the event of any accident, printing, administrative, or other error of any kind without prior notice or obligation.
By entering this contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing, and using the personal information submitted with his/her entry only for the purpose of administering the contest and in accordance with Sponsor’s Privacy Policy found at www.sqlpass.org unless the entrant otherwise agrees.
Failure to sign the eligibility affidavit and release consent form will result in the forfeiture of prizes. All federal, state, and local laws, rules, and regulations apply.
Winners are responsible for all taxes incurred on all prizes awarded. Winners may be required to provide their tax ID number for tax purposes. All prizes are non-transferable and non-assignable. The decision of PASS with regard to all matters relating to the contest, including matters not specifically addressed in these rules, shall be final. A prize not claimed in accordance with these rules will be forfeited and not awarded. All unclaimed prizes become the sole property of PASS. Winners have seven (7) days from the day contacted to claim their prize.
